Terms of Service

These Terms of Service (Terms) govern your use of the services provided by Australian Information Security Academy Pty Ltd (ABN 34 697 331 392) (AusISA, we, us), including our websites, our learning management system, and our courses, events, competitions, and other activities (together, the Services).

By booking, enrolling in, or participating in an AusISA activity, or by using our websites or learning platform, you agree to these Terms.

These Terms incorporate the AusISA policies published in the Participant Handbook, including the Participant Conduct Policy, Assessment Policy, Fees, Refunds & Cancellations Policy, Participant Vetting Policy, Ethical Use Policy, and Privacy Policy. Where these Terms conflict with a more specific policy, the more specific policy applies to the extent of the inconsistency.

These Terms operate subject to applicable Australian law, including the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded.

AusISA provides sovereign, practitioner-led cyber security training, including the IRAP Assessor Training Course delivered as an ASD-endorsed training provider, together with related events, competitions, and materials.

Course dates, formats, locations, inclusions, and prices are as published on our website at the time of booking, or as otherwise agreed in writing.

AusISA may update, improve, or vary course content between deliveries as part of continuous improvement. A material reduction in the advertised scope of a booked course entitles you to the remedies in the Fees, Refunds & Cancellations Policy.

Completion of a course does not guarantee any external outcome. In particular, passing the IRAP Assessor Training Course is one step in ASD's endorsement process, and endorsement decisions are made by ASD, not AusISA.

A booking is confirmed and a place secured in accordance with the Fees, Refunds & Cancellations Policy, which also governs payment terms, invoicing, cancellations, refunds, credits, and transfers.

Some activities have eligibility criteria, vetting, or invitation requirements under the Participant Vetting Policy. You must provide accurate and complete information when booking; providing false or misleading information is grounds for cancellation of enrolment without refund and, where relevant, notification of an endorsing entity.

You must be at least 18 years of age to book and pay for a Service. A parent, guardian, or other legally authorised representative must make and confirm a booking for a person under 18.

Where an employer or other third party pays for your booking, that party's rights and obligations are as set out in the Fees, Refunds & Cancellations Policy.

You must comply with the Participant Conduct Policy in all AusISA activities and digital spaces, and with the Assessment Policy in all assessed work.

You must use the knowledge, skills, and materials obtained through the Services ethically and lawfully, in accordance with the Ethical Use Policy.

You must keep your learning platform credentials secure, not share your account, and notify us promptly of any suspected unauthorised access.

You must not interfere with, disrupt, probe, or attack our websites, platforms, or lab environments except where an activity expressly authorises it and then only within the authorised scope.

You are responsible for meeting the stated technical requirements for online activities, including a suitable device, software, and internet connection, and a working camera for virtually invigilated assessments.

All course materials, assessment content, lab environments, recordings, documentation, branding, and other content provided through the Services are and remain the intellectual property of AusISA or its licensors (including, for some content, endorsing entities such as ASD).

You are granted a personal, non-exclusive, non-transferable licence to use course materials for your own learning in connection with the activity you are enrolled in.

You must not copy, share, publish, sell, sublicense, or otherwise distribute any full or partial part of AusISA materials (including course materials, assessment content, and recordings) without AusISA's prior written consent, as set out in the Participant Conduct Policy.

Nothing in these Terms transfers any intellectual property to you. Work you submit for assessment remains yours, but you grant AusISA a licence to use it for marking, moderation, quality assurance, and record-keeping in accordance with the Record Management Policy.

We handle your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).

You may access and seek correction of your records as described in the Privacy Policy and the Record Management Policy.

AusISA may cancel or reschedule a session for the reasons, and with the remedies, set out in the Fees, Refunds & Cancellations Policy.

AusISA may suspend or terminate your participation in an activity, or your access to the learning platform, where you breach these Terms or an incorporated policy, in accordance with the Participant Conduct Policy and the Complaints & Appeals Handling Policy.

AusISA may decline to provide a Service to a person, subject to applicable law. Where the refusal results from a vetting decision, the Participant Vetting Policy applies, including the right to a clearly articulated reason.

Certification outcomes are issued and may be withheld or revoked in accordance with the Assessment Policy and the Participant Conduct Policy.

Our Services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits those guarantees or any other right you have that cannot lawfully be limited.

Subject to clause 8.1, and to the maximum extent permitted by law, AusISA's total liability to you in connection with a Service is limited to, at AusISA's election, resupply of the Service or payment of the cost of resupply, and in any case is capped at the fees you paid for the Service giving rise to the claim.

Subject to clause 8.1, AusISA is not liable for indirect or consequential loss, loss of profit, loss of opportunity, or loss arising from events beyond AusISA's reasonable control, including venue loss, third-party platform outages, and force majeure.

You remain responsible for your own conduct, including your use of taught content after a course, as set out in the Ethical Use Policy. AusISA is not liable for any use you make of taught content.

Nothing in these Terms excludes liability that cannot be excluded by law, including liability for fraud or for death or personal injury caused by negligence.

Complaints and appeals about the Services are handled under the Complaints & Appeals Handling Policy, which is free to use and sets out our timeframes and your protections.

Nothing in these Terms prevents you from seeking any external review or statutory remedy available to you, including under the Australian Consumer Law.

These Terms are governed by the laws of the Australian Capital Territory and the Commonwealth of Australia, and the parties submit to the non-exclusive jurisdiction of the courts of the Australian Capital Territory.

If any part of these Terms is found to be invalid or unenforceable, that part is severed and the remainder continues in effect.

AusISA may update these Terms from time to time. The Terms in force at the time of your booking apply to that booking; updated Terms apply to subsequent bookings and to your ongoing use of the websites and platform. Material changes will be noted on this page with an updated revision date.

A failure by AusISA to enforce a provision of these Terms is not a waiver of that provision.
